India boasts a rapidly evolving economy, positioning itself to rival the world's largest international economies. The forces of globalization have ushered in an era of unprecedented trade opportunities, spanning manufacturing, services, cross-border commerce, and more. With globalization's advent, numerous foreign enterprises have established manufacturing footholds in India over recent decades. The manufacturing sector, a key driver of economic growth, holds the capacity to extend its reach far beyond national borders. By bolstering foreign exchange reserves and fueling economic progress, it stands as the linchpin of India's economic advancement.India emerges as an enticing hub for imports and manufacturing investments, attracting a slew of top-tier brands. Amazon, for instance, unveils plans to embark on electronic manufacturing ventures within Indian territory. Likewise, Samsung Display's substantial investment in Noida underscores the country's appeal for manufacturing endeavors. In a bid to further invigorate manufacturing growth, the Government of India extends a suite of tailored incentives, cementing the nation's status as a prime investment destination.
India's Role as a Prime Import Hub for Global Manufacturers. India stands out as a pivotal destination for international manufacturers seeking to export their goods, with a robust infrastructure facilitating seamless entry into the Indian market. The BIS FMCS Registration (Foreign Manufacturers Certification Scheme) presents an avenue for foreign entities to leverage standard marks, ensuring compliance with Indian standards. While India hosts a multitude of foreign enterprises, navigating diverse regulations and standards poses a challenge. Product conformity, testing, and marking are essential prerequisites for market entry. The Foreign Manufacturer Certification Scheme (FMCS) administered by the Bureau of Indian Standards under the ISI mark Scheme streamlines this process, enabling product certification and compliance with Indian standards.
The Foreign Manufacturers Certification Scheme (FMCS) has been operational under the Bureau of Indian Standards since 2000, operating within Scheme-I of Schedule-II, BIS Act, 2016, and the (Conformity Assessment) Regulations, 2018, catering specifically to foreign manufacturers. This scheme facilitates overseas applicants and manufacturers in obtaining the standard mark, commonly known as the ISI Mark, for marketing their products in India. The Foreign Manufacturers Certification Department (FMCD) serves as the exclusive authority empowered to issue BIS Certificates for imports to foreign manufacturers. BIS's primary objective in granting Manufacturing certificates to foreign manufacturers is to ensure the availability of high-quality, safe, reliable, and risk-free products to the public.
The BIS FMCS Certificate in India, issued by the FMCD department, caters to manufacturing units situated abroad. These units undergo factory audits to assess compliance with the requisite standards outlined by BIS. Additionally, foreign applicants are required to appoint an Authorized Indian Representative (AIR). To gain a comprehensive understanding of these processes, let's delve into the specifics of each parameter.
For foreign manufacturers, acquiring a BIS Certificate for Import in India under the FMCS Scheme is imperative to ensure uninterrupted exporting and marketing of their products in the Indian market.
The BIS Standard Mark or ISI Mark features a License number, denoted as 'CM/L-XXXXXXXXXX,' positioned at the bottom, with the Indian standard number displayed above the ISI Mark. This distinctive mark is bestowed upon by the Bureau of Indian Standards following the successful issuance of the BIS Certificate.
Foreign manufacturers intending to export their products to India must initially obtain a manufacturer certificate from the Bureau of Indian Standards (BIS), adhering to specific requirements outlined by the regulatory body. Absolute Veritas a renowned global consulting firm, specializes in BIS FMCS Registration, offering comprehensive advisory and consulting services to diverse industries in India and worldwide.
The manufacturing unit needs to be situated outside India.
Ensure that their product(s) comply with relevant Indian Standards Specifications (ISS).
All manufacturing machinery and testing facilities must be accessible at the factory premises.
The in-house laboratory should have product testing equipment and qualified quality control personnel to conduct tests in accordance with relevant ISS.
The manufacturer must agree to the Scheme of Inspection & Testing (SIT) and the annual marking fee.
The FMCS company/manufacturer must agree to the terms and conditions of the license.
Note: Separate applications must be submitted for each product and factory location. The list of products covered under FMCS is provided below.
Obtaining documentation for the FMCS BIS Certification scheme has become streamlined with the introduction of the BIS Online application system. The following are crucial documents that the applicant must possess before commencing the project:
Documents related to factory or company registration
Manufacturing process flowchart
In-house manufacturing capabilities and potential outsourcing agreements for manufacturing operations, where applicable.
Sufficient testing facilities
Quality control criteria and their corresponding records
Agree to the Scheme of Testing & Inspection and the Annual Marking fee, provide laboratory product testing reports, and furnish other necessary information in compliance with BIS norms. The documentation process may be extensive but can be obtained directly from BIS.
The FMCS BIS certification process comprises systematic steps aimed at facilitating the issuance of FMCS licenses to foreign manufacturers.
1)Application Submission:
Gather all necessary documents
Submit the application along with the required documents online to BIS and physically to the FMCD department
BIS authorities will review the application
2) Possible Queries:
Should there be any missing or incomplete documents, test equipment, or other requirements, communication will be conducted via email with the applicant.
Upon satisfaction with the application in all aspects, it will be duly noted.
An acknowledgment number will be assigned for future reference.
3) Audit/Inspection:
A BIS Officer will schedule a visit to the applicant's factory premises on a mutually agreed-upon date.
Payment of the inspection/audit fee will be required.
The BIS Officer will assess the manufacturing process, testing infrastructure, and conduct product testing in your in-house laboratory.
Samples will be collected by the BIS Officer, sealed, and sent to an independent laboratory for testing.
4) Testing of Samples:
Samples collected are dispatched to the BIS Approval Laboratory.
BIS (FMCS) receives the test report.
The BIS Officer will assess the manufacturing process, testing infrastructure, and conduct product testing in your in-house laboratory.
The application firm bears the charges for testing.
5) License Grant:
Upon receipt of a satisfactory inspection report from the auditor who visited the factory premises and the product test report conforming to Indian Standards.
The applicant is required to settle the License fee, advance minimum Marking fee, and any outstanding dues.
A Letter for Grant of License is then issued.
Indemnity Agreement:
An agreement and indemnity bond are established between the applicant and BIS, encompassing the following provisions:
Fees
Nomination
Licensee's rights and responsibilities
Indemnity
Termination
Performance bank guarantee
License cancellation
Non-renewal
Following successful completion of all aforementioned steps and payment of all applicable fees, the license will be granted. Initially, it will be issued for a period of 1 year, with the option for renewal in subsequent years.
Please note: A Performance Bank Guarantee of USD 10,000 from an RBI-approved bank must be submitted.
Total time for Certification will be approx. 4-6 months from the date of submission of Application documents.
Note: Separate application is required to be submitted for each product/Indian Standard and for each factory location.
Periodic surveillance inspections are conducted by BIS, during which market samples are collected to evaluate the performance of foreign BIS licensees.
Any received complaints regarding the licensee's products prompt an investigation in accordance with IS/ISO 10002 standards. Immediate actions, such as free replacements or repairs, are taken to address complaints. The licensee assumes full liability for any damages, and BIS bears no responsibility for losses or damages incurred.
A BIS-certified manufacturer's license is initially valid for one year and can be renewed annually by submitting a renewal application form along with the prescribed fees, duly certified by a Chartered Accountant.
Every foreign applicant or manufacturer must establish a branch office in India, responsible for fulfilling all obligations under the BIS Act of 1986 and related regulations for registration. In cases where foreign manufacturers or companies do not have a branch office in India, it is mandatory for them to appoint an Authorized Indian Representative (AIR) to obtain BIS Licenses and ISI Mark Certificates. The AIR serves as a local representative, handling the certification application process and addressing inquiries. When nominating an AIR, the applicant should ensure the following:
The Authorized Indian Representative (AIR) appointed by the foreign manufacturer must be a resident of India.
The AIR must provide consent, acknowledging responsibility for compliance with the provisions of the Indian BIS Act, Rules, Regulations, and the terms and conditions outlined in the BIS License, Agreement, Undertaking, or related documents executed on behalf of the foreign manufacturer.
An AIR can exclusively represent one foreign manufacturer at a time and cannot act as the AIR for other foreign applicants concurrently.
AIR(s) must maintain impartiality and avoid conflicts of interest regarding sample testing in third-party laboratories.
A bachelor's degree and familiarity with the provisions of the BIS Act of 2016, along with its rules and regulations, are the minimum qualifications for an AIR.
The name of the AIR must be included in the license documents.
Obtaining BIS Certification can be more complex than anticipated. Therefore, it is recommended that applicants enlist the services of a consultant to ensure a smooth and stress-free certification process.
