Key update regarding the Indian Standard applicable to current license holders, new applicants, manufacturers, importers, and product sellers for the Furniture (General purpose chairs and stools) (Quality Control) Order, 2023.
The Ministry of Commerce and Industry has recently released a Quality Control Order titled the Furniture (Quality Control) Order, 2023.
This order is scheduled to take effect twelve months after its publication. The official notification from the government is anticipated to be issued soon.
Under this order, all furniture items must comply with Indian Standard 17632:2022 for General Purpose Chairs and Stools and display the Standard Mark. To achieve this, they must obtain a license from the Bureau of Indian Standards under Scheme I of Schedule II as per the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.
There are exceptions to this order. Firstly, it does not apply to goods or articles manufactured domestically for export purposes.
Secondly, micro and small enterprises, as defined in the Micro, Small and Medium Enterprises Development Act, 2006, are exempt from this order for a period of eighteen months from its publication.
Furthermore, products manufactured by enterprises registered on the "Udyam Portal" of the Ministry of Micro, Small and Medium Enterprises, with investments in plant and machinery or equipment not exceeding twenty-five lakh rupees and turnover not exceeding two crore rupees, as certified by a Chartered Accountant, are exempt from this order.
The Bureau of Indian Standards acts as the authority responsible for certifying and enforcing compliance with this order for furniture goods or articles.
Non-compliance with this order may result in penalties as stipulated in the provisions of the Bureau of Indian Standards Act, 2016.
Individuals who violate these regulations will face legal consequences as outlined in the aforementioned Act.
