Battery Waste Management Regulations of 2022

Producer Registration: As per Rule 4 of the Battery Waste Management (BWM) Regulations 2022, all manufacturers and entities engaged in battery production must register with the Central Pollution Control Board (CPCB) via a centralized online platform. To initiate registration, an application using Form 1 (A) must be submitted to the CPCB. Producers are also obligated to apply for registration renewal using Form 1(A) at least sixty days prior to its expiration.

Under the BWM Regulations 2022, a producer is defined as an entity involved in the manufacture, sale, or import of batteries, including refurbished ones, either under their own brand or marketed by other manufacturers or suppliers.

The BWM Regulations operate under the framework of Extended Producer Responsibility (EPR), whereby battery producers are tasked with the collection, recycling, and refurbishment of waste batteries, as well as utilizing recycled materials from waste to produce new batteries.

EPR for Battery Producers: 'Extended Producer Responsibility' pertains to the obligation of battery producers to handle waste batteries in an environmentally sustainable manner, aiming to safeguard human health and the environment from potential adverse impacts of substances found in waste batteries.

Refurbishers and recyclers registration : Refurbishers and recyclers must complete a one-time registration process through the centralized portal with the State Pollution Control Board. Refurbishers and recyclers are mandated to provide quarterly reports using Form 4, outlining the quantities of used batteries collected or received from different producers or entities, the amounts of refurbished and recycled batteries, and the volumes of hazardous and/or other waste generated during refurbishment and disposal.

Government Guidelines on Battery Waste Management in 2022

These regulations are applicable to all entities engaged in the collection, sorting, transportation, refurbishment, and recycling of various categories of waste batteries, encompassing producers, dealers, and consumers. The regulations encompass all battery types, including portable, electric vehicles, automotive, and industrial batteries.

However, exemptions are granted for batteries utilized in equipment crucial to essential security interests, such as arms, ammunition, war material, and those explicitly designed for military applications, as well as equipment destined for space launch.

Registration Procedure for Battery Waste Management with CPCB

As the Online Centralized Portal of CPCB is still in the developmental phase, applications for registration are presently accepted offline. Below are the outlined steps for submitting an application to the CPCB via offline mode by the producer or manufacturer:

Documentation: The initiation of BWM Registration involves comprehensive documentation. Initially, the Absolute Veritas Team gathers and organizes all requisite information and paperwork, aligning with CPCB standards, on behalf of the producer.
Application Submission: The Absolute Veritas team will then proceed to apply for CPCB registration on behalf of the producer, dispatching the designated application form via mail along with a hard copy to the Central Pollution Control Board. Alongside the application form, all necessary documents will be submitted.
Application Review: Upon receipt of the completed application, CPCB will undertake a thorough review.
Registration Approval: Subsequent to the application review, provisional registration will be granted for an initial six-month period. Once the online portal becomes operational, registration may be extended for an additional six months. Notably, the collection of application fees will be deferred until registration via the centralized online portal, wherein fees will be processed.
