On December 6, 2024, the Ministry of Environment, Forest and Climate Change (MoEF&CC) released a groundbreaking draft notification under the Environment (Protection) Act, 1986, focusing on Extended Producer Responsibility (EPR). This initiative targets efficient management of packaging waste and sanitary products like diapers and sanitary napkins, holding producers accountable for the entire lifecycle of their products.
EPR is a policy framework that places the onus of collection, recycling, and disposal on Producers, Importers, and Brand Owners (PIBOs). The objective is to reduce environmental impact by encouraging sustainable practices, recycling, and resource conservation.
Under the new EPR guidelines, PIBOs must:
Meet stringent recycling targets.
Use recycled content in their packaging materials.
Establish comprehensive waste management schemes for packaging and sanitary product disposal.
This aligns with global sustainability goals, advancing India towards a circular economy and promoting a cleaner environment for future generations.
1. EPR Scope
The guidelines cover:
Packaging materials: Paper, glass, and metal (excluding non-ferrous metal under hazardous waste).
Sanitary products: Diapers, sanitary napkins, and similar products.
Note: Plastic packaging remains under the existing Plastic Waste Management Rules, 2016.
2. Recycling Targets
Mandatory targets for PIBOs are:
-Packaging:
70% by 2026-27
85% by 2027-28
100% from 2028-29 onwards
-Sanitary Products:
60% by 2026-27
70% by 2027-28
80% by 2028-29
100% by 2029-30
3. Minimum Recycled Content
PIBOs must integrate recycled materials into their packaging:
Paper: 40% by 2026-27, 70% by 2029-30.
Metal: 20% by 2026-27, 50% by 2029-30.
Glass: 50% by 2026-27, 80% by 2029-30.
4. Registration & Compliance
All PIBOs must register via a centralized online portal managed by the Central Pollution Control Board (CPCB) or respective State Pollution Control Boards (SPCBs). Non-compliance will restrict trade operations.
5. EPR Certification & Surplus Credits
Producers exceeding recycling targets can earn surplus EPR certificates, which can be carried forward, offset, or sold to other PIBOs.
6. Penalties for Non-Compliance
Under the polluter-pays principle, PIBOs failing to meet targets will face Environmental Compensation (EC). However, fulfilling obligations within three years allows partial EC refunds.
7. Sanitary Waste Management
Producers of sanitary products must:
Send waste to registered incineration facilities.
Procure EPR certificates from authorized incinerators to ensure compliance.
8. Implementation Timeline
The EPR guidelines will take effect from April 1, 2026, giving businesses ample time to align with compliance requirements.
