OVERVIEW

The Ministry of Commerce & Industry has introduced a Quality Control Order titled the "Hinges (Quality Control) Order, 2023."

This order will take effect six months after its publication in the Official Gazette.

According to this directive, hinges must comply with the specified Indian Standard 362:1991 (Parliament hinges) and show the Standard Mark, necessitating a license from the Bureau of Indian Standards under Scheme-1 as outlined in Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations for 2018.

Importantly, this order excludes goods or articles produced domestically for the purpose of export.

Additionally, the timeline for enforcement varies depending on enterprise classification. For micro-enterprises, as defined in the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), the order will take effect twelve months after publication. For small enterprises, it will apply nine months after publication.

The Bureau is responsible for certifying and enforcing hinges under this regulation. It's important to note that any breach of the conditions in this order may result in penalties in accordance with the Bureau of Indian Standards Act, 2016.

According to the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), micro-enterprises will need to comply with the order twelve months after its publication, while small enterprises will do so nine months after the publication date.
