OVERVIEW
The Ministry of Commerce and Industry Releases Quality Control Order: Introducing the "Electrical Appliance Fans (Quality Control) Order, 2023"
It will be enforced six months post its publication in the Official Gazette.
As per this regulation, adherence to the designated Indian Standard IS 302 (Part 2 or Sec 80): 2017 is mandatory for all electrical appliance fans. Additionally, these items must prominently feature the Standard Mark and acquire a license from the Bureau of Indian Standards, as per Scheme-1 specified in Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.
It's crucial to note that this directive excludes domestically manufactured goods intended solely for export.
For micro enterprises, as per clauses (h) and (m) of section 2 of the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), the enforcement will commence twelve months post-publication. Similarly, this timeline applies to small enterprises as well, defined under the same Act.
The Bureau of Indian Standards serves as the authority entrusted with certification and enforcement duties to uphold compliance with this directive.
Individuals or entities found breaching these regulations will be subject to penalties as stipulated by the Bureau of Indian Standards Act, 2016.
