Insertion of New Proviso: The Ortho Phosphoric Acid (Quality Control) Order, 2021 has been amended with a new proviso added after the existing table. This update specifies:

Provided that nothing in this Order shall apply to Ortho Phosphoric Acid used as a raw material in the production of fertilizers

Scope and Applicability: This Order is applicable to Ortho Phosphoric Acid goods or articles, except those intended for export. All Ortho Phosphoric Acid products must comply with Indian Standard IS 798:2020 and display the Standard Mark, which is granted under a license from the Bureau of Indian Standards (BIS) in accordance with Scheme-II of Schedule-II of the BIS (Conformity Assessment) Regulations, 2018.

Certification and Enforcement: The Bureau of Indian Standards (BIS) is designated as the certifying and enforcing authority for Ortho Phosphoric Acid goods or articles. BIS will oversee compliance with the established standards.

Penalties: Any individual or entity that violates the provisions of this Order will face penalties under the Bureau of Indian Standards Act, 2016. This amendment ensures that while Ortho Phosphoric Acid used in fertilizer production is exempt from the quality control order, rigorous standards are enforced for other applications.
