Dear Reader,
Key update regarding the Indian Standard applicable to current license holders, new applicants, manufacturers, importers, and product sellers for the Cement Quality Control Order, 2003.
Definitions:
"Act" refers to the Bureau of Indian Standards Act, 1986 (63 of 1986).
"Appropriate Authority" denotes an officer of at least Under Secretary rank in the Government of India or a General Manager of a District Industries Centre at the State Government level, as appointed by either the Central Government or State Government through an Official Gazette notification.
"Bureau" signifies the Bureau of Indian Standards.
"Cement" encompasses all varieties manufactured or sold in India, including but not limited to IS 12330: Sulphate Resisting Portland Cement, IS 12600: Low Heat Portland Cement, IS 1489 (Part 1): which specifies Portland Pozzolana Cement based on fly ash; IS 1489 (Part 2), which details Portland Pozzolana Cement made from calcined clay; IS 269, which covers Ordinary Portland Cement; and IS 3466, which pertains to Masonry Cement. IS 455: Portland Slag Cement, IS 6452: High Alumina Cement for Structural use, IS 6909: Super Sulphated Cement, IS 8041: Rapid Hardening Portland Cement, IS 8042: White Portland Cement, IS 8043: Hydrophobic Portland Cement, IS 8229: Oil Well Cement, IS 16415: 2015: Composite Cement – Specification, IS 16993: 2018: Microfine Ordinary Portland Cement – Specification, IS 15895: 2018: High Alumina Refractory Cement, or any other variety specified by the Central Government.
"Dealer" refers to any individual, firm, or Hindu Undivided Family involved in the buying, selling, supplying, or distributing of cement.
"Manufacturer" means any individual, firm, or Hindu Undivided Family engaged in the production, making, or manufacturing of cement, including those claiming such production.
"Specified Standard" refers to the Indian Standard Specification for cement as prescribed by the Bureau of Indian Standards.
"State Government" includes the administration of Union Territories.
All other terms not defined in this Order will have the meanings assigned to them in the Act.
Prohibition on Non-Standard Cement:
No individual or entity is allowed to manufacture, store for sale, sell, or distribute cement that does not meet the specified standards.
The Central Government may authorize the manufacture or sale of cement without the Standard Mark for up to 150 days if the Standard Mark is still pending.
Exemptions from the Standard Mark may be granted for cement produced for export purposes, provided it meets international standards or the buyer's specifications.
Cement that fails to meet the specified standards must be destroyed within one month.
Obligations for Certification:
Manufacturers must apply to the Bureau of Indian Standards for a license to use the Standard Mark within 45 days of the issuance of this Order, if they do not already possess one.
The issuance of a license will follow the provisions of the Act and applicable rules and regulations.
Individuals or entities intending to manufacture cement must submit their application to the Bureau prior to beginning production.
The Bureau is required to promptly notify the Appropriate Authority about the expiry, cancellation, or rejection of any license.
Power to Call for Information:
The Appropriate Authority has the power to request information and samples from any person involved in the manufacture, storage, sale, or distribution of cement.
The Appropriate Authority can inspect books, documents, and cement held by individuals or entities engaged in these activities.
The Authority is authorized to enter and search premises and seize cement suspected of not meeting the prescribed standards, in accordance with the Code of Criminal Procedure, 1973 (2 of 1974).
Testing of Samples:
Cement samples bearing the Standard Mark, collected by the Appropriate Authority, will be tested in a Bureau-approved laboratory to ensure they meet the specified standards.
Compliance with Directions:
All individuals or entities involved in the manufacture, storage, sale, or distribution of cement must adhere to the directions issued under this Order.
Obligation to Furnish Information:
No manufacturer or dealer shall refuse to provide any lawfully requested information, or conceal, destroy, mutilate, or deface any books, documents, or cement in their possession or control with the intent to evade the provisions of this Order.
