Key update regarding the Indian Standard applicable to current license holders, new applicants, manufacturers, importers, and product sellers for the Cookware and Utensils (Quality Control) Order, 2024.

OVERVIEW

The Ministry of Commerce and Industry has issued the "Cookware, Utensils, and Cans for Foods and Beverages (Quality Control) Order 2024."

This order will come into effect on September 1, 2024.

Under this order, products such as Cookware, Utensils, and Cans for foods and beverages must comply with Indian Standard IS 9396 (Part 1): 1987 for Round Open Top Sanitary Cans used for Foods and Drinks made from Tinplate. These items must display the Standard Mark after obtaining a license from the Bureau of Indian Standards under Scheme-1 as outlined in Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018. It's important to note that this order excludes domestically manufactured products intended solely for export purposes.

Regarding compliance deadlines, Small Enterprises as defined in the Micro, Small and Medium Enterprises Development Act, 2006, must comply starting December 1, 2024. Similarly, Micro Enterprises under the same act are required to comply starting March 1, 2025.

Moreover, products manufactured domestically by an enterprise registered on the "Udyam portal" of the Ministry of Micro, Small and Medium Enterprises, with restricted investment and turnover, are exempt from compliance with this order.

The Bureau of Indian Standards has been appointed as the certifying and regulatory authority for the goods or articles specified in this order. Failure to comply with its provisions may lead to penalties under the Bureau of Indian Standards Act, 2016.
